    Description

    Assists the public in filing involuntary petitions mandated under Florida's mental health laws - Baker Act and Hal Marchman Act (formerly the Myers Act, Drug Act); Retardation Act; Tuberculosis Act; Incapacity; Adult Protective Service Act. BAKER ACT: This act is used to commit (to a mental health care/treatment facility) a family member who is showing evidence of mental illness. For emergencies, the police can Baker Act someone who is a danger to themselves or others. Call 911. In non-emergency situations, the Baker Act can be initiated by any person who has been in contact with the allegedly ill person. They do not have to be blood relatives. These people must contact the offices of the Mental Health Division and appear in person to file a "complaint". A hearing will be set within five working days. The complainants must be prepared to offer testimony regarding the actions of he allegedly ill person. The judge will then decide whether to commit the person to an inpatient facility. In crisis situations, the police, physicians, and Licensed Clinical Social Workers also have the authority to institute the Baker Act, and the police have the authority to transport the person to a mental health facility. The police can Baker Act a person for a period of 72 hours. HAL MARCHMAN ACT: (formerly Drug Act) This act deals with involuntary commitments for substance abuse treatment (both alcohol and drug abuse). Petitions may be filed by a spouse, blood relative, or three citizens of Florida. Patients must be served notice of the hearing in person by summons. Emergency commitment is not handled by the court. GUARDIANSHIP/CONSERVATORSHIP: This involves appointing a guardian or conservator for someone who, because of age or incapacity, is unable to manage their own affairs.

      St. Lucie Mental Health Court is a community-based program that provides court supervision and services to mentally ill offenders through the cooperation of State, County and local non-profit agencies. Case referrals are approved by the State's Attorney's Office and defendants receive medication, therapy counseling, help with housing, vocational training, help with Social Security and case management.
